General terms and conditions of Miles & More GmbH for Status Event tickets
1. Our VIP ticket offer
Miles & More GmbH (“MMG”) offers selected status customers with more than 10,000 Qualifying Points for Lifetime status (hereinafter “eligible members”) limited VIP tickets to exclusive events (“events”) in exchange for miles under the Miles & More programme.
MMG and Deutsche Lufthansa Aktiengesellschaft (“DLH”), as operators of the Miles & More programme, and our event agency Startourguide are not the organisers of the events offered. MMG is merely an intermediary for these services. The organiser of the respective event is the issuer of the VIP ticket and is identified as such on the ticket (“organiser”).
Tickets are only valid on the specified day or during the specified period. You can order one ticket per event and, depending on the event, a varying number of additional tickets for people accompanying you. The number of additional tickets available for each event is specified on the booking form.
Only a limited number of tickets are available for each event.
The tickets are personal to the holder and can only be ordered by the eligible member. They cannot be transferred to a third party. The sale, exchange or auctioning of tickets is prohibited. Additional tickets for accompanying persons can only be used in conjunction with the ticket held by the eligible member. Any additional information in the ticket description and on the tickets must be noted. The organiser’s house rules and policies for use of the venue apply.
2. Conclusion of contract
Our presentation of the tickets merely represents a non-binding invitation to order tickets. After placing your order, you will receive a confirmation email. This is a confirmation of receipt and does not constitute a legally binding acceptance of your order. Tickets are allocated on a first-come, first-served basis and may quickly run out. Contracts between the organiser and you enter into force with the explicit confirmation of your order in a separate email.
The ticket remains the property of the organiser until the miles have been completely redeemed.
If, in individual cases, there is a discrepancy between the product image shown in the offer and the information listed in the related ticket description, the information presented in the ticket description shall apply.
3. Issuing of tickets
Tickets will be issued to you at the event location by our event agency Startourguide. You are responsible for making your own travel arrangements at your own expense.
4. Exclusion of the right of withdrawal or return
Under Section 312g, para. 2, clause 1, no. 9 of the German Civil Code (Bürgerliches Gesetzbuch), a right of withdrawal shall not exist with regard to services to be provided at set times in connection with leisure activities. A right of return or exchange shall also not exist. This will not affect your legal rights against us accruing from defects.
5. Redeeming miles for Miles & More awards
In addition to these general terms and conditions, the Miles & More terms and conditions of participation apply with regard to redeeming miles and requesting awards.
Please note that it is only possible to book a ticket if you have enough miles in your mileage account. For Senators and HON Circle Members, the use of mileage advances is excluded for Status Events.
6. Data protection
As an intermediary, MMG processes personal data for the purpose of booking your Status Event. MMG processes the following personal data for this purpose: surname, first name, date of birth, Miles & More service card number and email address. This data is transmitted to the organiser of the respective Status Event for booking and issuing the ticket. The legal basis for processing is the performance of a contract, Art. 6(1)(1)(b) GDPR. Insofar as personal data is transmitted to third countries, appropriate safeguards are provided for the protection of your personal data in accordance with the statutory regulations (in particular the EU adequacy decision and the use of EU standard contractual clauses; you can find information about EU standard contractual clauses on the websites of the European Union). MMG may use service providers for the booking of Status Events. Where these are external processors as per Art. 28 GDPR, such service providers will have been carefully selected and will only act in accordance with our instructions. They will provide sufficient guarantees that they will comply with their obligations under data protection law. Your personal data will be deleted as soon as it is no longer required for the stated purposes. We may need to store your personal data until the expiry of any retention obligations and periods defined by legislation or by the supervisory authorities. These may derive from the German Commercial Code (Handelsgesetzbuch) or German Tax Code (Abgabenordnung), and are generally between six and ten years. We may also retain your data until the end of the statutory limitation periods (usually three years, but up to 30 years in some cases), providing this is necessary to establish, exercise or defend legal claims. The relevant data will then be routinely erased. As the data subject, you can exercise the following rights where the respective statutory conditions exist: right of access, Art. 15 GDPR, right to rectification, Art. 16 GDPR, right to erasure (“right to be forgotten”), Art. 17 GDPR, right to restrict processing, Art. 18 GDPR, right to data portability, Art. 20 GDPR, and right to object, Art. 21 GDPR. Concerning the right to object, Art. 21 GDPR: you have the right to object at any time, on grounds pertaining to your particular situation, to any processing of personal data relating to you which is based on Art. 6(1)(1)(e) or (f) GDPR. We will then no longer process your personal data, unless we can demonstrate compelling legitimate grounds for such processing which outweigh your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims. You can object to the processing of your personal data at any time. In order to process your application and identify you, please note that we will process your personal data in accordance with Art. 6(1)(c) GDPR. You also have the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR in conjunction with Section 19 of the Federal Data Protection Act (Bundesdatenschutzgesetz).
