Terms and conditions of participation for the “Your Miles & More Year in Review 2024” lucky draw

1. Organiser

Miles & More GmbH, Main Airport Center, Unterschweinstiege 8, D-60549 Frankfurt, Germany (hereinafter “MMG”) is hosting the “Your Miles & More Year in Review 2024” lucky draw (hereinafter “lucky draw”) on the miles-and-more.com website during the specified period. MMG is the sole organiser of the lucky draw.

2. Promotion period and participation

The lucky draw will run from 10.12.2024 (12:01 a.m. CET) to 31.1.2025 (11:59 p.m. CET).

3. Eligibility, implementation and administration

All Miles & More members can take part in the lucky draw providing they have reached the age of 18 at the time of participation, have received the “Your Miles & More Year in Review 2024” email and have not been excluded from taking part in accordance with the conditions set out below or by MMG. Lufthansa Group employees and their family members are excluded from taking part. MMG is entitled to exclude individual members with just cause. In such cases, prizes may be retroactively revoked and recalled if necessary. The use of scripts or any other kind of automated process to manipulate this lucky draw is prohibited and will likewise lead to exclusion from it.

 

Eligible Miles & More members can take part in the lucky draw by registering at miles-and-more.com. The winners will be drawn at random from among all registered participants. The prizes will be drawn at the end of the promotion. The prizes will then be credited automatically to the winners’ Miles & More account within four weeks of the draw.

 

Any Miles & More member whose Miles & More account has been blocked, closed or restricted, or is blocked, restricted or closed during the promotion period, is excluded from taking part.

4. Prize

There are 10 prizes of 100,000 miles to be won. Winners may not claim any other prize. The prize cannot be altered or exchanged. It is not possible to provide a cash alternative (either in full or in part). Prize claims cannot be transferred to others.

5. Data protection

As the organiser of the lucky draw, MMG processes personal data in order to carry out and administer the luck draw. MMG collects the following personal data for this purpose: surname, first name, date of birth, Miles & More service card number and email address.The legal basis for processing is the performance of a contract, Art. 6(1)(1)(b) GDPR. We may use third-party service providers to carry out the lucky draw. Where these are external processors as per Art. 28 GDPR, such service providers will have been carefully selected and will only act in accordance with our instructions. They will provide sufficient guarantees that they will comply with their obligations under data protection law.Your personal data will be deleted as soon as it is no longer required for the stated purposes. However, we may need to continue to store your data until the expiry of any retention periods and deadlines defined by legislation or by the supervisory authorities. These may derive from the German Commercial Code (Handelsgesetzbuch) or German Tax Code (Abgabenordnung), and are generally between six and ten years. We may also retain your data until the end of the statutory limitation periods (usually three years, but up to 30 years in some cases), providing this is necessary to establish, exercise or defend legal claims. The relevant data will then be routinely erased. As the data subject, you can exercise the following rights where the respective statutory conditions exist: right of access, Art. 15 GDPR, right to rectification, Art. 16 GDPR, right to erasure (“right to be forgotten”), Art. 17 GDPR, right to restrict processing, Art. 18 GDPR, right to data portability, Art. 20 GDPR, and right to object, Art. 21 GDPR. Concerning the right to object, Art. 21 GDPR: you have the right to object at any time, on grounds pertaining to your particular situation, to any processing of personal data relating to you which is based on Art. 6(1)(1)(e) or (f) GDPR. We will then no longer process your personal data, unless we can demonstrate compelling legitimate grounds for such processing which outweigh your interests, rights and freedoms, or such processing is required for the establishment, exercise or defence of legal claims. You can object to the processing of your personal data at any time. To exercise your rights, you can use our “GDPR - request for information” contact form at miles-and-more.com. In order to process your application and identify you, please note that we will process your personal data in accordance with Art. 6(1)(c) GDPR. You also have the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR in conjunction with Section 19 of the Federal Data Protection Act (Bundesdatenschutzgesetz). 6. Changes to the terms and conditions of participation and termination of the lucky draw

MMG reserves the right to amend the terms and conditions of participation at any time. If individual provisions of the terms and conditions of participation are or become invalid, this shall not affect the validity of the remaining terms and conditions of participation. Furthermore, MMG reserves the right to terminate or suspend the lucky draw at any time without notice. This applies in particular to any reasons that may disrupt or prevent the planned operation of the lucky draw.

7. Disclaimer

MMG shall not be liable for any losses, in particular those that may arise as a result of errors, delays or interruptions when using the website; during transmission; in the event of disruption to technical systems and service; due to inaccurate content, the loss or deletion of data, viruses or in any other way in the course of participation, unless such losses are caused by MMG through wilful intent or gross negligence. The exclusions to liability stated above do not apply to injury to life, physical injury or injury to health. Furthermore, these exclusions to liability do not apply in the case of a negligent breach of obligations, the fulfilment of which is essential for the proper operation of the lucky draw, the violation of which jeopardises the purpose of the contract, and the adherence to which participants may generally rely upon; in such cases, MMG is only liable for foreseeable losses that are typical for the contract.

8. Miscellaneous

The law of the Federal Republic of Germany shall apply to this lucky draw. The organiser’s decision is final. Please bear in mind that any winnings from this promotion may be subject to income tax. Any taxes due on winnings are owed by the winners themselves and must be paid to the relevant tax authority.
